Welcome to the webpage of the Medico-Legal Society of Malaysia! 

What a whirlwind of a last 2 years we have had. The healthcare industry was challenged in ways that were unfathomable and the legal industry grappled with new issues that required fresh strategies and brave thinking.  MLSM continues to be in the thick of thought leadership in Malaysia.

Our History & Objectives
Since its inception 35 years ago, the MLSM has gone a long way in playing its aspirational and pivotal role as an important voice in the medico-legal landscape. 

The Medico- Legal Society of Malaysia continues in its commitment to educate, provoke thought leadership and to kick start important conversations that have been recognized by the confluence of doctors and lawyers coming together under this august Society. 

Our Focus
Among the issues for discussion that are becoming increasingly important are the mental health of healthcare providers and mental capacity issues for the vulnerable members of our community which draw both the doctors and lawyers into important conversations.

Apart from this, over the years MLSM has bravely highlighted the issues relating to patient-doctor-hospital-insurer relationships and the impact of disputes on the confidence, morale and crucial dynamics between patients and doctors (and hospitals). 

Recently, MLSM has spotlighted other issues including the declining morale and contractualisation of relationships in the healthcare industry, among others. A call out has been made to stakeholders to find better ways of resolving disputes authentically and swiftly in order to promote confidence in healthcare which would ultimately benefit society as a whole. To this end, the medical insurers and professional indemnity providers play a crucial role in addressing the rising number of claims and complaints while managing their own commercial interests. It is a generally held view that patient disputes and dissatisfaction can and should be resolved as soon as possible and avoided, where possible, through better communication and better practices.

For many years, MLSM has endeavoured to highlight the best and better medico-legal practices to encourage the healthcare industry and its advisors. These conversations have been led by lawyers and doctors who understand the high ethics required for each of their professions and generously share these best practices and better medico-legal practices with the fellow members of the Society.

Following from the multiple echos in the recent APHM- MLSM conference on 2nd June 2022 with the theme: Trust and Sustainability in Healthcare, MLSM will be keeping a spotlight on the need for better systems to address patient grievances and to address disputes in a way that balances the mental well-being of patients and doctors with the commercial needs and interests of patients, doctors, hospitals and insurers.

Acknowledgement
I take this opportunity to recognize the Immediate Past President Dato Dr Venugopal Balchand, whose unique and effective leadership saw MLSM pivot itself through the Covid-19 crisis and put special spotlights on the needs of healthcare workers and various vulnerable groups. In particular, MLSM inspired conversations on the decriminalisation of suicide and the pressing need for a Mental Capacity Act (and related guidelines and regulations) which is seriously lacking in the Malaysian legislative framework.

The Current Team and the Path Ahead
Moving ahead, my team and I, who comprise doctors and lawyers from both public and private sector, will continue to focus on conversations and initiatives promoting the mental wellbeing of healthcare workers and the growing need for better systems to deal with medical negligence matters as well as to work with other stakeholders in expediting the establishment of a Mental Capacity Act and its antecedent system for supervised decision-making for the most vulnerable members of our society. 

Our unique and dynamic Exco comprise lawyers familiar with medico-legal issues and sensitive to all divides of a dispute as well as doctors spanning multiple disciplines as well as authors on medico-legal literature and academicians with numerous special interests. 

Our strength is in our diversity as well as our common ground.  For the first time ever, the President and both Vice Presidents (Legal and Medical) of MLSM while being lawyers and a doctor respectively – all are certified Mediators of the Malaysian Mediation Centre – setting the stage for more conversations on Medical Mediation and the wisdom of early, effective problem-solving in medical negligence matters.

What is Next for MLSM
This year we intend to honour the founders and all members of MLSM with a Members Only Event in December 2022. We look forward to welcoming all members at this upcoming event.

As MLSM continues to inspire important conversations and meaningful actions, this website will showcase our upcoming events, activities, achievements and provide members with updated information about the activities of MLSM for which participation and contribution will be encouraged.
